The purpose of this page is to define the General Terms and Conditions of Sale and Use (GTCU) under which the Club of Investors in Parking lots and Garages (CIPG) makes the Website www.parking-garage.com and various Services available to Users, as well as the rights and obligations of Visitors, Contributors or Members.

Any person browsing the Website www.parking-garage.com, whether a Visitor, Contributor or Member, accepts these General Terms and Conditions of Sale and Use (GTCU) and undertakes to comply with them.

The website of the Club of Investors in Parking lots and Garages (CIPG) is an IT platform for putting real estate investors in touch with each other; it can provide, directly or indirectly, associated services for all users of the site.

The General Terms and Conditions of Sale and Use (GTCU) can be consulted online and may be modified at any time at the discretion of the Club of Investors in Parking lots and Garages (CIPG) without any formality other than being put online. Only the latest online version, or the online version at the time of the events in question, shall be applicable to the Parties.

Article 2 : Parts

The « Club of Investors in Parking lots and Garages (CIPG) » is represented by Mr Christophe MARTIN. Registered under the Siret number : 820 744 647 00018, the head office is located at 91 allée Rosa Parks 42153 RIORGES, France. Provides the Site and the Services.

« Visitor » is a natural person who navigates on the Site.

« Contributor » means any visitor who has sent an e-mail, posted a comment, announcement or Contribution on the Site.

« Member » is a natural or legal person who has joined the club and subscribed to the Services including access to the exchange platform.

Article 3 : Subject

The purpose of these General Terms and Conditions of Sale and Use (GTCU) is to inform Visitors, Contributors and Members about the terms and conditions of subscription to the Services and the conditions of use on the Website www.parking-garage.com.

The Club of Investors in Parking lots and Garages (CIPG) provides Visitors, Contributors and Members with a Platform and Services aimed at facilitating the acquisition and management of real estate assets, in particular :

  • to inform them about the investment related to the real estate niche of car parks, garages, boxes, cellars, sheds, warehouses, commercial or artisanal premises;
  • personalise documents (letters, rental contracts, company status);
  • facilitate contact between them and other investor members, landlords, lessors or sellers.

Use of the CIPG (Club of Investors in Parking lots and Garages) website is reserved for Visitors who have read and accepted these General Terms and Conditions of Sale and Use (CGVU) without reservation. Visitors are also reminded that any subscription of paid option(s) by a Visitor implies full and complete acceptance of these terms and conditions.

Article 4 : Definitions

In the context of these General Terms and Conditions of Sale and Use (GTCU), the terms and expressions identified by a capital letter have the meaning indicated below, whether they are used in the singular or plural :

  • Advertisement : refers to all the elements describing a property (visuals, texts and photographs) placed by an Advertiser under his editorial responsibility.
  • Advertiser : means any natural person of full age, acting exclusively for private purposes, who has placed an Advertisement on the Website to rent or sell a property.
  • Document : means any document, model letter, simulator or rental agreement used or contracted between a Visitor and one of the Members of the Club of Investors in Parking lots and Garages (CIPG) under the responsibility of each party.
  • Need : request for support or advice expressed by one of the Members of the Club of Investors in Parking lots and Garages (CIPG).
  • Club of Investors in Parking lots and Garages (CIPG) : designates the club, its legal representative Mr Christophe MARTIN.
  • Order : refers to any Service ordered by a Visitor or Member on the Club of Investors in Parking lots and Garages (CIPG).
  • Contributor : means any Visitor having sent an e-mail, comment, Announcement, Contribution ; or published on the site for information purposes.
  • Contribution : means any work (text, e-mail, comment, announcement, showcase page, document, forum, photograph, audiovisual or multimedia work) that the Contributor sends to the Club of Investors in Parking lots and Garages (CIPG). It is understood that all exchanges: questions, answers and comments constitute Contributions.
  • Tenant : means any natural person of full age or legal entity who has signed a rental agreement with a Visitor or Member of the Club of Investors in Parking lots and Garages (CIPG).
  • Member : refers to any natural person of full age or legal entity that is a member of the Club of Investors in Parking lots and Garages (CIPG) and is up to date with its membership fees.
  • Showcase Page : refers to the page that presents a property for rent selected from the Advertisements, parking of a Member or advertising selection considered as a Contribution.
  • Parties : means any Advertiser, Contributor, Member or Visitor on the one hand and the Club of Investors in Parking lots and Garages (CIPG) on the other hand.
  • Site : refers to the website and the parking-garage.com domain, operated by the Club of Investors in Parking lots and Garages (CIPG), accessible mainly from the URLs : www.parking-garage.com, www.cipg.fr and www.parking-garage.info and www.parking-garage.eu ; allowing Visitors, Users and Advertisers to access the Service via the Internet.
  • Service : means access to content by the Member, all documents, simulators, reports and modules offered for sale on the website of the Club of Investors in Parking lots and Garages (CIPG).
  • User : means any individual or legal entity using all or part of the Products or Services of the Club of Investors in Parking lots and Garages (CIPG) website, including Advertiser, Visitor, Contributor and Member.
  • Visitor : refers to any individual or legal entity visiting and browsing the website of the Club of Investors in Parking lots and Garages (CIPG) including Advertiser, Contributor and Member.

Article 5 : Club membership

Any natural person of full age or legal entity may freely become a Member of the Club of Investors in Parking lots and Garages (CIPG). The Visitor may only use all the Club’s Services after registering and obtaining the status of Member, and logging in with his or her e-mail address or personal username and password as identifiers. The Member can modify all the information he or she entered during registration by using the management parameters of his or her account. He or she is responsible for all actions carried out using his or her login information, and in particular, but not exclusively, for his or her Contributions.

5.1). Application for membership

When applying for membership, the Visitor undertakes to provide accurate, up-to-date and complete information. The Club of Investors in Parking lots and Garages (CIPG) may at any time verify the information provided and refuse a membership application without having to give reasons for its decision. In the event of refusal of membership, the Club undertakes to reimburse the membership fee collected; the Visitor thus refused shall not be entitled to any penalty or damages.

To create an account and become a Member, the Visitor must :

  • fill in her e-mail address,
  • give a password which he undertakes to keep confidential,
  • give a username,
  • give his phone number,
  • proceed to the payment of the membership fee.

The creation of an account implies the adherence to these Terms of Use. By registering, the Visitor agrees in particular to receive information from the Club of Investors in Parking lots and Garages (CIPG) by e-mail, which he may unsubscribe from by simply asking the club’s team.

5.2). Membership status

A Visitor acquires the status of Member of the Club of Investors in Parking lots and Garages (CIPG) from the moment his registration has been validated. The admission of Members is subject to the payment of an annual fee, the amount of which, without commitment or subscription, is set at 60 € (sixty euros) per year and per Member. There are 2 Member statuses: the normal status which gives access to the exchange platform and the Premium status which unlocks all bonus content.

5.3). Subscription option with automatic annual renewal

At the request of certain members, a registration mode with automatic annual renewal is available on our site with a discount of approximately 20% on the price of the membership without commitment. You must create a Paypal account to register your preferences and create a regular recurring payment. You can unsubscribe free of charge by following the Paypal forum instructions by clicking on this link.

The Subscribing Member will continue to have access to the service until the end of the annual billing period. Failing an action on the part of the Member, the subscription will be renewed under the same conditions each year.

The pricing conditions of the subscription appear on the Site, and are those in force at the time of the order. These prices do not include the cost of the Internet connection, which remains the responsibility of the Visitor or Member and is at his or her expense.

The subscription is concluded intuitu personæ for use exclusively for the Member’s internal use. The Member shall refrain from assigning the subscription and / or any rights and obligations arising therefrom to a third party by any means whatsoever.

5.4). Access to the Member Area

Each Member of the Club of Investors in Parking lots and Garages (CIPG) has a username and a password to connect to the exchange platform and thus obtain a lot of confidential information that can help him/her in the search or management of his/her property. It is reminded that the connection identifiers cannot be transmitted to a third party, under penalty of being struck off the Club of Investors in Parking lots and Garages (CIPG).

5.5). Active or passive member

Our club represents two investor profiles: Active Members who actively participate in discussions and answer questions from other Members and Passive Members who feed our exchange platform by expressing their Needs and Expectations. There is no obligation within our club, each Member is free to participate or not in the discussions. Throughout his or her membership period, a Member may change investor profiles several times depending on his or her activity within the Club of Investors in Parking lots and Garages (CIPG).

5.6). Team member and ambassador

All Club Members can apply to volunteer to join the team and become an ambassador, each application will be considered. A Member who becomes an ambassador receives privileged access to the club’s management module with rights established according to his or her volunteer activity: forum, blog, site, moderation or administration. These rights are likely to evolve over time. It is expressly reminded that an Ambassador Member does not have the right to use the information and contact lists in the team module for personal or commercial purposes.

5.7). Webinar and videoconferencing

The community module allows you to exchange between Club Members, the Club of Investors in Parking lots and Garages (CIPG) reserves the right to record a webinar and/or video conference to allow all other Members to review it on video. The participation of a Member in a webinar and/or videoconference implies the waiver of the Member’s image rights.

5.8). Awards

To reward the most active Members who participate most in the life and development of our club. The Club of Investors in Parking lots and Garages (CIPG) can propose internal contests and offer gifts on an exceptional basis. These rewards are not goods in kind but discount vouchers that can be used to order a Service: renew an annual membership fee or upgrade to Premium Member status.

5.9). Call for moderation, drifts and sanctions

In case of a call for moderation (to ask a question or request a moderation action), do not forget that the functioning of the exchange platform and the forum relies on the action of a few volunteers who are not always instantly available. Give them time to get to know the subject and to act.

The best moderation is self-moderation. What to do in case of overflow? In the event of a dispute, or if you feel that a member has overstepped the limits, you should try to resolve the problem privately, through direct dialogue, rather than resorting to moderation immediately. These disputes must not give rise to controversy in public on the Site.

If you cannot resolve the dispute directly, contact the moderation (or click on « report or complaint »), indicating the context and the exact references of the disputed messages. The moderation provides for graduated levels of intervention depending on the situation:

  1. The moderation intervenes with the authors by sending an e-mail to the authors of the litigious messages, informing them that their exchanges go outside the framework of the rules of the forum and asking them, depending on the situation, to reformulate or modify their text. The moderator indicates on the forum, following the litigious post, that a moderation action is in progress and invites the other participants not to continue the controversy. If the interested parties correct their posts themselves, the moderation action is over. Otherwise, the moderation action goes up a notch. If the moderation concerns insulting, racist, xenophobic, sexist, or forbidden by law, the moderation goes directly to step 2.
  2. Moderation hides and archives contentious posts, or even locks the topic. In the absence of any reaction from the interested parties, the moderation hides and archives the litigious messages, warning the authors by email. If the subject tends to be controversial, the moderation can choose to lock the subject. The moderation posts a message on the moderated subject explaining the moderation action and reminding the rule concerned. If it is a minor breach, the moderation action is over; in case of serious breach or recurrence, the moderation action goes up one or even two notches.
  3. Moderation suspends the account for one week. In case of serious breach (insulting, racist, xenophobic, sexist, or forbidden by law) or recurrence (two moderation actions in 3 sliding months), the moderation can decide collegially to suspend the access to the forum by the person concerned for one week. The moderator informs the interested party by e-mail, referring to the moderated comments and the rules concerned.
  4. Moderation calls upon the Club Manager. In the event of repeated serious breaches, repeat offences (four actions of moderation in 12 months on a sliding scale) or in certain special cases on the collegial advice of the moderators, the moderation can call upon the Club Manager. The Club Manager can decide on measures ranging from the suspension of the account for one month to the permanent removal from the forum or platform, or even the community.

Any action of moderation gives rise to communication to the interested parties, communication and traceability on the exchange platform or forum and archiving of messages that may be hidden. The choice of moderators must be respected, it is however possible to indicate one’s disagreement and the moderators or the governing bodies are available to discuss it.

Remember that the club and its extension, the exchange platform and the forum, are places of sharing, not places of polemics! These rules are simple: the administration and moderation team simply asks you to respect them. Whatever the situation concerned, favour respect and dialogue and give the moderators time to carry out the most relevant actions according to the situation.

5.10). Suspension of account or resignation of a Member

In order to keep the list of Community Members up to date, an account that has been inactive for more than 3 consecutive months may be suspended at any time without notice. A suspended Member may not claim any refund of membership fees, penalties or damages.

Resignation is a right that each Member may exercise at any time. A Member wishing to leave the Club of Investors in Parking lots and Garages (CIPG) must send an e-mail of resignation to the club manager using the contact form on our Website. A resigning Member is not entitled to any refund of membership fees, penalties or damages. All Member Contributions will remain the property of the Club of Investors in Parking lots and Garages (CIPG).

5.11). Deregistration, exclusion of a Member

Only the Head of the Investor’s Club of Investors in Parking lots and Garages (CIPG) can decide on the striking off or exclusion of a Member if one of the following situations occurs :

  • Non-payment of the annual fee or an Order,
  • Transmission of its identifiers to a third party,
  • Dissemination of a given information in the member area,
  • Disrespectful behaviour or remarks towards a third party,
  • Non-compliance with the laws in force,
  • Use of a false identity or impersonation,
  • Serious misconduct affecting the balance and image of the Club of Investors in Parking lots and Garages (CIPG),
  • Failure to respect the rules of moderation.

A Member who is cancelled or excluded cannot claim any refund of membership fees, use of rewards, payment of penalties or damages. The Club of Investors in Parking lots and Garages (CIPG) reserves the right to take legal action against any excluded person in order to claim damages if their misconduct has caused them harm.

5.12). Former Member status

Unsubscription has no effect on previous transfers; in particular, the Club of Investors in Parking lots and Garages (CIPG) will be able to continue to use the Contributions of the former Member who has become a Visitor. The Visitor thus automatically undertakes to waive any legal action or intellectual property rights on all Contributions exchanged with the Club of Investors in Parking lots and Garages (CIPG).

Article 6 : Rules of good conduct

Each Visitor and each Member is solely responsible for the information, messages and, in general, any content he or she disseminates via the interactive services of the Club of Investors in Parking lots and Garages (CIPG) such as the commentary, forum, private messaging or quote request services.

Each Visitor undertakes not to do anything that might prejudice the honour or consideration of the Club of Investors in Parking lots and Garages (CIPG), its activities or its representatives.

All contributions and communications openly condoning crimes against humanity, inciting racial hatred, violence, of an erotic, pornographic, defamatory, libellous, insulting, deceptive, insulting to persons, contrary to public order or morality, as well as commercial parasitism are prohibited. The account of any Member or Visitor who does not respect these conditions may be closed, and his or her messages deleted, without prior notice.

In addition, the Contributor undertakes to make entirely original contributions. Any copy, paraphrase or reminiscence of a text written by a third party, published or not, is strictly prohibited. The Club of Investors in Parking lots and Garages (CIPG) warns Contributors against borrowing from websites, books, newspapers or magazines, studies, memoirs or white papers, booklets, etc…

In the event of a breach of these provisions, the Contributor shall be solely liable. Moreover, the Club of Investors in Parking lots and Garages (CIPG) may then, depending on the seriousness of the facts :

  • correct or delete the disputed Contribution(s) ;
  • and/or automatically and without notice close access to the Visitor ;
  • and/or file a legal recourse according to the seriousness of the facts.

In the event of dissemination of works constituting illegal content or plagiarism, the Visitor is encouraged to alert the moderation service of the Club of Investors in Parking lots and Garages (CIPG) by e-mail, indicating in the subject line « Illegal content » or « Plagiarism », and specifying the link to the page where the litigious content appears.

The Visitor accepts that the Club of Investors in Parking lots and Garages (CIPG) may take the initiative, without prior notice, to delete, in whole or in part, any content that it broadcasts or that is sent to it via the interactive services, if this content is likely to infringe the laws and regulations in force or morality.

The Visitor undertakes to use the quote request service for personal purposes and for real and serious services. The Visitor undertakes to provide accurate information in his requests for quotes. Any abusive use of the service may be subject to legal proceedings. For example, requests for quotes that are fanciful, or containing false information, or usurping the identity of a third party, and the creation of multiple accounts for the same individual are considered abusive.

Article 7 : Methods of making Contributions available

The Contributor guarantees that he is the author of the original files or texts of his Contributions. Article 8 : Order

The electronic contact details to be used for each of the parties will be specified by any means at their convenience when they are first exchanged. The Visitor and the Club of Investors in Parking lots and Garages (CIPG) agree that the electronic contact details are sufficient to identify the sender of the electronic document and to authenticate its origin.

8.1). Validation of an order

The Visitor or Member wishing to acquire a Service undertakes to pay the Club of Investors in Parking lots and Garages (CIPG) the sum provided for when the Order is validated in accordance with the payment conditions below :

  • 100% of the price before execution.

This payment can be made by bank transfer, credit card via Paypal, Paypal transfer or by check. An Order is processed and considered as validated as soon as the Visitor or Member has paid it.

8.2). Changing an order

The technical characteristics mentioned in the advertising and/or communication media of the Club of Investors in Parking lots and Garages (CIPG) are given for information purposes only and have no contractual value. The CIPG reserves the right to make any technical modifications to the Services offered, without affecting their essential characteristics. If a Member or Visitor wishes to make a modification to an Order, he must promptly contact the club team using the contact form on the site.

8.3). Implementation schedule

The execution time is indicative for all Services. For so-called “standard” Services, such as the purchase of a document template or report, the delivery time is instantaneous with the unlocking of the Website page giving access to the Service. For “personalized” Services, such as club membership, the delivery time is from a few hours to 5 days.

If the execution deadline is imperative for a Visitor, Tenant or Member, the latter must specify it when placing the Order. The execution deadlines above as well as all the deadlines mentioned herein are in working days.

8.4). Cancellation of an order

Le Visiteur, Locataire ou Membre qui souhaite annuler toute ou partie de sa Commande de Service, doit contacter dans un délai de 14 jours le Club of The Visitor, Tenant or Member who wishes to cancel all or part of his Service Order, must contact the Club of Investors in Parking lots and Garages (CIPG) within 14 days by email to the club team. It is reminded that the cancellation of a Club membership does not normally entitle the Member to any refund or compensation, as the Member has had the opportunity to copy the entire contents of our Website. Except in the particular case where the Visitor or Member would never have been connected to the exchange platform via the use of his identifiers (username, e-mail address or password). The moderator of the club, considered as a neutral party, will certify whether the Visitor or Member in question has accessed the exchange platform.

In the event of a conviction against the Club of Investors in Parking lots and Garages (CIPG), and regardless of the nature of the prejudice (direct/indirect) or the origin of the damage, the sums paid by the Club of Investors in Parking lots and Garages (CIPG) shall, by mutual agreement, be expressly limited to the amount of the price of the Order.

The Member shall reimburse to the Club of Investors in Parking lots and Garages (CIPG) all costs incurred up to the date of receipt of the cancellation, notwithstanding any damages that may be payable by the Member in compensation for the direct and indirect loss suffered by the Club of Investors in Parking lots and Garages (CIPG) as a result of such cancellation.

Any natural person of full age or legal entity may freely use the services of the Club of Investors in Parking lots and Garages (CIPG). The User may use part of the Services modules without being a Member of the club. It is of course understood that each Visitor using all or part of a Service takes responsibility for all actions carried out using his or her login information, and in particular, and not exclusively, for his or her Contributions.

The parties further agree to implement in parallel all useful measures to protect themselves in the most effective way possible against intrusions and attacks of all types (viruses, worms, Trojan horses…) and in particular firewall and anti-virus regularly updated and correctly configured to guarantee the availability, integrity and confidentiality of e-mails and attached files exchanged between them via the Internet in the context of the execution of the present agreement.
Members shall be personally responsible for archiving the documents issued and received, in particular for their own tax and accounting purposes.

Article 14 : Privacy

The parties undertake to treat as confidential all commercial, financial, technical or other information and Contributions obtained within the framework of the execution of the Members’ support or an Order for a Product or a Service. Each of the Members undertakes not to disclose to unauthorized third parties any confidential information or significant know-how that the other Members may have communicated to it.

In this regard, each of the Parties undertakes to take the following safeguard measures :

  • Refrain from communicating to third parties in any way whatsoever, all or part of information that is by nature confidential, even after the expiry or termination of a membership or these general conditions of sale and use (GCSU).

Article 15 : Personal data

Any processing of personal data hereunder is subject to the provisions of the Privacy Policy, which forms an integral part of these General Terms and Conditions of Sale and Use (GTCU).

Article 16 : Intellectual property

16.1). General reminder

Article 18 : Tolerance

Any tolerance or waiver of its right by either party, relating to the application of all or part of the commitments provided for in these general conditions of sale and use (GCSU), whatever the frequency or duration, shall not constitute a modification of these general conditions of sale and use (GCSU), nor generate for the future to the benefit of the other party an acquired right or of any nature whatsoever.

Article 19 : Severability of clauses

The invalidity arising from the nullity, lapse, lack of binding force, unenforceability of any of the stipulations of the general conditions of sale and use (CGVU) pronounced in application of a law, a regulation or a final decision by a competent court, does not in any way entail nullity, These General Terms and Conditions of Sale and Use (GTCU) shall be null and void, non-binding or unenforceable and shall have no effect with respect to the other contractual provisions, which shall retain all their effects, force and scope with respect to all parties. In this case, the parties may come together and, by mutual agreement, agree to replace or modify the invalidated stipulation(s).

Article 20 : Independence

The Parties acknowledge that they are acting and contracting in their own name and on their own behalf and that they are bound only by the title and conditions of these General Terms and Conditions of Sale and Use (GTCU).
Neither of the Parties is authorised to make any commitment whatsoever in the name and/or on behalf of the other Party.
No Member may override the decisions of the Head of the Club of Investors in Parking lots and Garages (CIPG).
Furthermore, each of the parties (Visitor and Member) remains solely responsible for his or her actions and declares that he or she assumes full responsibility for his or her actions, allegations, commitments, services, products and personnel.

Article 21 : Sincerity

The parties sincerely declare the commitments made by them under the terms of these general conditions of sale and use (CGVU) which they undertake to execute in good faith.

Article 22 : Languages

The original version of these general conditions of sale and use (GCSU) was written in French. Thus, the French version will be considered as the official version between the parties. In the event of a dispute between the parties concerning the present general conditions of sale and use (CGVU), the French version will prevail over any other version.
Similarly, in the event of the need to translate these general terms and conditions of sale and use (GTCU) into languages other than those referred to above, it is agreed that only the French version shall be deemed authentic between the parties.

Article 23 : Further information

The Club of Investors in Parking lots and Garages (CIPG) provides the Visitor with an e-mail information service using our contact form for any information or complaints concerning access to or use of the functionalities of our Website.

Article 24 : Litigation management

24.1). Out of court

With a view to finding an amicable solution to any dispute that may arise between the parties in connection with the execution of these general conditions of sale and use (CGVU), the parties agree to approach each other and to each designate internally a person with decision-making power to manage the dispute.
These two persons shall meet, at the initiative of the most diligent party, within thirty (30) days from the notification of the other party requesting the holding of a conciliation meeting. The agenda shall be set by the party at the initiative of the conciliation and may be amended and finally agreed upon by the parties in a contradictory manner at the first meeting.
Minutes will be taken of the meeting within thirty (30) days from the date of the meeting and will be binding.

24.2). Conciliation with third party intervention

In the event of failure of the amicable phase above or of persistence of points of difficulty, the parties may amicably designate a man able to decide between them.
The conciliator shall attempt to conciliate the parties within two months of the first meeting and shall formalize a report to this effect, dated and signed by him.
If this report is accepted by the parties, the latter undertake to sign a confidential transaction, within a maximum period of thirty (30) days from the date of the aforementioned report, which must expressly state whether these General Terms and Conditions of Sale and Use (GTCU) continue to apply and under what conditions.

24.3). Jurisdiction

In case of failure of the conciliation procedure: the present general terms of sale and use (CGVU) are subject to the provisions of French law. For Professional Member customers, it is agreed that the court of the place of the registered office of the service provider company shall have sole jurisdiction in the event of disputes to which this contract may give rise, concerning its validity, interpretation, execution, termination, consequences and consequences. For consumer Member customers, disputes that could not be resolved amicably will be submitted to the competent courts under the conditions of common law.
